1.- INTRODUCTION:

Welcome to Video Total Short.

These Terms of Service («Terms») govern the access to, purchase of and use of all digital products offered through the Video Total Short website.

By accessing this website, purchasing any product or downloading any digital content, you agree to comply with these Terms of Service.

If you do not agree with these Terms, you should not purchase or use any products available on this website.

2.- ABOUT VIDEO TOTAL SHORT:

3.- DEFINITIONS:

For the purposes of these Terms:

Original File means the digital file delivered after purchase.

4.- DIGITAL PRODUCTS:

All products sold through Video Total Short are digital products.

Each product page includes preview images and/or preview videos allowing customers to evaluate the product before purchasing.

The preview material is provided solely for evaluation purposes.

The purchased Product consists exclusively of the downloadable digital file made available after successful payment.

5.- COMMERCIAL LICENCE:

Upon successful completion of the purchase, the Customer receives a perpetual, worldwide, non-exclusive, non-transferable and royalty-free commercial licence to use the purchased Product.

The licence authorises the Customer to use the purchased video in an unlimited number of completed projects, provided that such use complies with these Terms of Service.

The licence is granted only to the original purchaser and may not be transferred, assigned or sublicensed to any other person or organisation.

Ownership of the Product is not transferred.

Only a licence to use the Product is granted.

Video Total Short retains all copyright, intellectual property rights and all other proprietary rights in and to the Product, except for the limited licence expressly granted under these Terms.

6.- ROYALTY-FREE COMMERCIAL LICENCE:

The purchase price includes a complete royalty-free commercial licence.

Once the Product has been lawfully purchased, no additional licence fees, royalties, recurring payments or revenue sharing will ever be required for any authorised use covered by these Terms.

For the avoidance of doubt, «royalty-free» means that once the original purchase price has been paid, no additional licence fees, royalties, commissions or revenue sharing shall ever become payable to Video Total Short for any authorised use of the Product under these Terms.

Customers are expressly authorised to use the purchased videos in monetised content.

Authorised monetisation includes, without limitation:

YouTube Shorts monetisation
TikTok monetisation
Facebook monetisation
Instagram commercial content
Advertising campaigns
Corporate marketing
Client projects
Paid presentations
Commercial websites
Digital advertising

Customers retain 100% of the revenue generated from their own authorised projects incorporating the purchased video.

Video Total Short will never claim:

royalties;
recurring licence fees;
advertising revenue;
monetisation revenue;
commissions;
revenue sharing;
ownership of the Customer’s finished work.

The only payment due to Video Total Short is the original purchase price of the Product.

This royalty-free commercial licence is one of the fundamental principles of Video Total Short.

7.- PERMITTED USES:

Subject to full compliance with these Terms of Service, the Customer is authorised to use the purchased Product in an unlimited number of completed personal and commercial projects.

Blogs

Commercial advertisements
Corporate presentations

The Customer may edit, crop, colour grade, combine, animate, resize, add music, sound effects, voice-over, subtitles, graphics, logos, visual effects, transitions, artificial intelligence generated content, or otherwise modify the purchased Product as necessary for incorporation into the Customer’s own completed projects.

The Customer may also incorporate the purchased Product into AI-assisted creative workflows and artificial intelligence generated projects, provided that the original downloadable Product is not redistributed, resold or made available as a standalone digital asset.

The Customer may publish, distribute, broadcast, display and monetise any completed project incorporating the purchased Product without restriction, provided that the original Product itself is not redistributed in violation of these Terms.

8.- PROHIBITED USES:

The licence granted under these Terms does not permit the Customer to:

resell the original Product;
redistribute the original digital file;
sublicense the Product;
give away the Product free of charge;
upload the Product to stock media marketplaces;
include the original Product in any competing stock library;
claim ownership or authorship of the Product;
register the Product as intellectual property belonging to the Customer;
make the original downloadable file publicly available;
use the Product in any unlawful, fraudulent or misleading activity.
use the Product in unlawful, defamatory, hateful, abusive or deceptive content.

The purchased Product must always form part of a new creative work produced by the Customer.

The original digital file may never be distributed as a standalone product.

9.- INTELLECTUAL PROPERTY:

All Products available through Video Total Short are protected by applicable copyright laws and international intellectual property legislation.

All copyright, neighbouring rights, database rights, trademarks and any other intellectual property rights relating to the Products remain the exclusive property of Video Total Short.

Nothing contained in these Terms shall be interpreted as transferring ownership of any intellectual property rights to the Customer.

The Customer acquires only the limited licence expressly granted under these Terms of Service.

10.- CUSTOMER RESPONSIBILITIES:

The Customer is responsible for safeguarding the downloaded Product after purchase.

The Customer shall take reasonable measures to prevent unauthorised copying, distribution or misuse of the original digital file.

The Customer is responsible for ensuring that all uses of the Product comply with applicable laws and these Terms of Service.

Video Total Short shall not be responsible for any unlawful use of the Product carried out by the Customer or by third parties who obtain the Product through the Customer.

11.- PRICES AND PAYMENT:

All prices displayed on the Website are shown in the applicable currency at the time of purchase.

Payment is required in full before any Product becomes available for download.

Video Total Short reserves the right to modify prices at any time.

Any price changes shall not affect purchases already completed.

All applicable taxes shall be charged in accordance with the laws applicable to the transaction.

12.- DELIVERY OF DIGITAL PRODUCTS:

Products are delivered electronically.

Following successful payment, the Customer will receive immediate access to download the purchased Product, subject to the proper functioning of the payment platform and download service.

No physical media will be delivered.

The Customer is responsible for downloading and securely storing the purchased Product.

13.- TECHNICAL REQUIREMENTS:

The Customer is responsible for ensuring that their own hardware, software and internet connection are suitable for downloading, storing and using the purchased Products.

Video Total Short does not guarantee compatibility with every editing application, operating system or third-party platform.

Minor differences in colour, image rendering or playback may occur depending on the Customer’s equipment and software environment.

14.- REFUNDS AND CANCELLATIONS:

Due to the nature of digital products, all sales are final once the Product has been successfully delivered or made available for download.

Customers are encouraged to review all preview images, preview videos, descriptions and technical specifications before completing their purchase.

Refunds will only be considered where required by applicable law or where Video Total Short determines, at its sole discretion, that a technical error has prevented delivery of the purchased Product.

A request for a refund based solely upon personal preference, change of mind or failure to read the Product description shall not constitute valid grounds for a refund.

15.- DISCLAIMER OF WARRANTIES:

All Products are provided «as is» and «as available».

Video Total Short makes every reasonable effort to ensure that all Products meet the quality standards described on the Website.

However, Video Total Short does not warrant that every Product will meet the particular requirements, expectations or intended purposes of every Customer.

16.- LIMITATION OF LIABILITY:

To the fullest extent permitted by applicable law, Video Total Short shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from the purchase, download or use of any Product.

The total liability of Video Total Short arising from any claim relating to a Product shall never exceed the purchase price actually paid by the Customer for that Product.
